Hiring and Compensating Physicians and APPs: Regulatory Traps and Practical Guidance for Practice Managers

Supporting the recruitment and onboarding of physicians and advanced practice providers is one of the most important, and at times complex, functions a practice manager oversees. From implementing compensation arrangements that satisfy fair market value and commercial reasonableness requirements under the Stark Law and Anti-Kickback Statute, to navigating the dos and don'ts of employment agreements, the regulatory landscape is full of potential pitfalls that can expose a practice to significant liability. This presentation will walk through the key legal and regulatory considerations that arise when recruiting, compensating, and employing physicians and APPs, including common compliance mistakes, best practices for structuring compensation models, and essential contract provisions every practice manager should understand. Meet the Speaker: Mara J. Rendina is a Partner and Health Law Regional Service Line Leader at Shumaker, Loop & Kendrick, LLP. She has over a decade of experience advising hospitals, physician groups, and medical professionals on a wide range of health care legal matters. Before rejoining Shumaker, Mara spent over nine years as in-house counsel at ProMedica Health System, where she led the legal enterprise for its hospital and provider division. Her practice encompasses health care transactions, physician compensation, regulatory compliance, nonprofit governance, and hospital operations,. Mara has worked with clients ranging from large academic medical centers to community hospitals, multi-specialty physician groups, and individual clinicians. Mara earned her J.D., summa cum laude, from the University of Toledo College of Law, where she was inducted into the Order of the Coif, and holds a B.A., cum laude, from Albion College. Aerin T. West is an Associate at Shumaker, Loop & Kendrick, LLP, where he is a member of the firm's Corporate, Tax and Transactions; Labor and Employment; and Health Care service lines. Aerin's journey with Shumaker began as a Summer Associate, a role he held for two consecutive years, gaining comprehensive exposure to intersecting areas of the law. He is a graduate of the University of Toledo College of Law and holds an undergraduate degree from the University of Cincinnati, where he was a collegiate soccer player.
